South Carolina has very strict DUI laws and your DUI defense has to be rock solid to ensure that you do not receive the maximum penalties allowed by law. Those involved in fatal DUI accidents will receive much harsher punishments than what is listed below.
- 1st Offense: Leniency is seen with a first offense. The typical jail time ranges from 2 – 90 days with fines in the range of $400 – $1,000. A 6 month license suspension will be included.
- 2nd Offense: Second offenses are much more serious with jail time ranging from 5 days to 3 years. Fines will be between $2,100 and $6,500, and your license will be suspended for one year.
- 3rd Offense: Third time offenders will receive 60 days to 5 years’ worth of jail time and $3,800 – $10,000 in fines. A third time offender will lose their license for 2 years.
- 4th Offense: If you have been arrested for your fourth DUI, you will face very serious penalties. Jail time of a minimum of 1 year and a maximum of 7 years plus fines up to $10,000 will follow. A permanent license suspension will be upheld.
Felony DUI Circumstances
When fatal DUI accidents occur, they will be considered a 1st or 2nd degree felony. This is dependent on the situation at hand and will come with severe jail time and penalties. As a felon, a person will lose the right to vote, bear arms and will have the felony on his or her criminal record permanently.
Restitution may be required to pay the victim’s family and court trials will be commonplace.
